Terms of Service
The powerblockgroup.com website (the “Site”) is comprised of various web pages operated by The Power Block Group LLC (TPBG). The Site is offered to you conditioned on your acceptance, without modification, of the terms, conditions, and notices contained herein (the “Terms”). Your use of the site constitutes your agreement to all such Terms. Please read the Terms carefully and maintain a copy for your reference.
Services Offered:
The Power Block Group LLC, is presently offering Reservations & Hosting Contract(s). Both have a minimum order of 25 unit spaces.
1. Reservations
Reservation Terms & Conditions: Customer(s) will be eligible to reserve future space on a first come first served basis. The minimum amount of spaces that can be reserved is 25 units, the maximum amount for one customer will be 300 units (Without requiring management approval). Reservations are not transferable and can only be redeemed by the individual(s) or company that has purchased them. Customer(s) whom purchase reservation(s), and wish to initiate hosting service(s), must complete a separate hosting contract within 21 days after “Notice of Commencement,” has been sent. If Hosting Contract is not received in such time, then reservations will be considered unoccupied and space will become the property of The Power Block Group LLC.
Reservation Cancellation & Refund Policy – Customers whom terminate a reservation(s), issued by The Power Block Group LLC, within 72 hours of initial reservation time & date is subject to receive a full refund including reservation fees associated. Customers whom terminate reservation(s), issued by The Power Block Group LLC, following a 72 hour period from initial reservation purchase time & date will not be eligible for a refund.
2. Hosting Service Contracts
B. Hosting Service Contract Terms & Conditions: Customer(s) will be eligible to purchase hosting services when and if space is available. All hosting service contracts are for a minimum of a 12 month period. Hosting service contracts require the prepayment of the first and last month hosting fees to initiate hosting service. Subsequent payments are then required on a monthly basis 10 days prior to the next service month. Expiring contract(s) can be renewed for an additional 12 months by purchasing a renewal contract found in the members section. If service is terminated for non-payment, customer’s equipment will be returned/shipped to customer stated address within 10-14 business days. If service is not renewed by current hosting customer, equipment will be returned/shipped to customer’s stated address 3-7 days after last paid month and the expiration of such hosting contract. Customers are responsible for all shipping & handling fees.
Hosting Contract Cancellation & Refund Policy – Customers whom opt for non-renewal of contract must provide a written notice 30 days in advance. Customers whom seek immediate termination of hosting contract(s), issued by The Power Block Group LLC, must provide a written notice 60 days in advance. Customer(s) equipment will be returned/shipped to customer’s stated address 3-7 days after last paid month and the expiration of hosting contract. The Power Block Group LLC does NOT offer refunds on hosting contracts or deposits.
Qualification:
Customer(s) must be at least eighteen (18) years old and are legally allowed to use The Power Block Group LLC website and services outlined by laws and regulations pertaining to each customer. Customer(s) whom have contract(s) revoked or terminated are not qualified to use our services.
Taxes
Applicable taxes shall be added to the price of services, unless specified.
VPN Access:
The Power Block Group LLC strives to offer uninterrupted VPN access to our clients. In the event where such offering of service is not possible, The Power Block Group LLC will hold no obligation to uphold this service. The Power Block Group LLC reserves the right to limit and/or restrict VPN access, or services associated, to customers at it’s discretion.
Billing Agreement:
1. Bills are generated in the first day of each previous month. Payment is due within 21 days from the bill generation date. If payment is not received within 21 days of issuance, the hosting contract will be terminated and customer’s units will be shipped to customers stated address within 3-7 business days following the close of their last paid hosting month.
2. We accept payment by BTC/Wire Transfer.
General Service-level Agreement:
1. Installation of Miners – 3-5 Business Days.
2. Physical Restart of Miners – 1 Business Day.
3. Fan Replacement/Firmware Upgrade – 2 hours if requested during business hours or a maximum of 1 Business Day.
4. Pool Changes – Instant. Optional VPN access. Manual pool changes within 2 hours during business hours.
5. Soft Restart – Instant. Optional VPN access. Manual restarts within 2 hours during business hours.
* Fan Replacement Fee: $20 per fan.
Insurance:
The Power Block Group, LLC. insures our customer(s) units from events such as floods, fires, and thievery. The Power Block Group, LLC. is excused for any failure to perform according our Terms, if such failure is caused by forces beyond our control. These forces include, (but are not limited to) acts of governments, acts of terrorism, electrical/power failure, market failures, or industrial/labor disputes.
Downtime:
We do not provide any credits on downtime less than 24 hours within each month, If downtime exceeds 24 hours, we provide credit towards customer’s next billing cycle.
Termination:
Your contract will be terminated without prior notice or reason(s), including breach of Terms of Service. Misuse of web-server application, VPN service, and website will be regarded as a breach of such Terms.
Privacy Policy:
We will only disclose your personal information as outlined in our privacy policy. By accepting terms put forward by,” The Power Block Group LLC,” you acknowledge and agree to that privacy policy.
International Users:
This Site is controlled, operated, and administered by The Power Block Group LLC from our offices within the United States of America (“USA”). If you access the Site from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use The Power Block Group content accessed through powerblockgroup.com in any country or in any manner prohibited by applicable laws, restrictions, and regulations.
Changes to Terms:
The Power Block Group LLC reserves the right, in its sole discretion, to change Terms under which powerblockgroup.com operates. The most current version of the Terms will supersede all previous versions. The Power Block Group LLC encourages you to periodically review the Terms to stay informed of updates.
